Among the many who send me e-mail alert my readers, I included in the post on an article describing research carried out by ISPESL SGSL published at "no cost" of Confindustria Campania (not updated to D . lgs. 106/2009). The article is more of a promotion of SGSL and is done to "encourage" employers to adopt it. Nothing new, as yet not I receive reports on interesting materials and / or guidelines produced for the SGSL be applied in the construction industry. Delegate functions and effectiveness extenuating circumstance SGSL

I must point out an interesting article published by the lawyer. Antonio Salvatore on his blog in which he is a very detailed examination of what's new regulations of the Decree. 106/2009 concerning the delegation of functions and their effects in relation to the function of the models of SGSL extenuating circumstance. The item is made by a lawyer and lawyers, then very little interest to anyone involved in technical aspects and applications of SGSL. However, puts the focus, rightly, on an item of particular importance: the effective compliance of the "certainty" of the rule (Article 30 TUS) compared to the schemes of obligations and penalties related to the employer, especially in the case of delegation of functions. Accidents at work: the first sanctions "231"

in the post I am attaching an article in the Sun 24 Hours this week (Thursday 10/12) which shows the first conviction for an accident at work which have been fully subject to the penalties provided for by Legislative Decree no. 231/2001 (almost up to 1.5 million € for FS and about half a million euro for smaller companies that were contracted out the cleaning of the tanks). The interesting fact of the sentence is not only related to the construction of a specific case law on it (is the first case on the subject) but also condemned the apparent contradiction in having a large company like FS that had, at least formally adopted a SGSL. The adoption of the system, therefore, was not considered as extenuating circumstance responsibilities under the Decree. 231/2001, despite the signs article. 30 of the MLR. It will be interesting to assess the rationale of the court to understand how the formal adoption of both "soft" legal obligation towards you if you do not have concrete evidence of its effectiveness. Corporate Social Responsibility (RSI): ISO 26000

were presented in Rome on 24 November in the anticipation of what will be the ISO 26000 standard, that the guidelines for companies wishing to actually adopt a policy of social responsibility ( RSI). I was impressed with the standard proposed for two reasons:
1) does not require a certification it requires the development of a management system. Tip, however, the actual applicability and the direct involvement of employees. Compared to the traditional standard of "certification" it seems a big step forward.
2) the issue of security is central to the proceedings, well connected with environmental issues and sufficiently flexible to be adopted by smaller businesses and, more importantly, also by construction SMEs. What matters are, in fact, the results and not the bureaucracy.
A good appreciation, then, the work done so far (it nourished the presence ISO committee in Italian).
