Among the many who send me e-mail alert my readers, I included in the post on an article describing research carried out by ISPESL SGSL published at "no cost" of Confindustria Campania (not updated to D . lgs. 106/2009). The article is more of a promotion of SGSL and is done to "encourage" employers to adopt it. I must point out an interesting article published by the lawyer. Antonio Salvatore on his blog in which he is a very detailed examination of what's new regulations of the Decree. 106/2009 concerning the delegation of functions and their effects in relation to the function of the models of SGSL extenuating circumstance. The item is made by a lawyer and lawyers, then very little interest to anyone involved in technical aspects and applications of SGSL. Accidents at work: the first sanctions "231"

in the post I am attaching an article in the Sun 24 Hours this week (Thursday 10/12) which shows the first conviction for an accident at work which have been fully subject to the penalties provided for by Legislative Decree no. 231/2001 (almost up to 1.5 million € for FS and about half a million euro for smaller companies that were contracted out the cleaning of the tanks). The interesting fact of the sentence is not only related to the construction of a specific case law on it (is the first case on the subject) but also condemned the apparent contradiction in having a large company like FS that had, at least formally adopted a SGSL. The adoption of the system, therefore, was not considered as extenuating circumstance responsibilities under the Decree. 231/2001, despite the signs article. 30 of the MLR. Corporate Social Responsibility (RSI): ISO 26000

were presented in Rome on 24 November in the anticipation of what will be the ISO 26000 standard, that the guidelines for companies wishing to actually adopt a policy of social responsibility ( RSI). I was impressed with the standard proposed for two reasons:

L’obiettivo primario del mio blog non è tanto quello di promuovere la cultura della c.d. “certificazione” della sicurezza (SGSL): quello è un tema che fa “gola” alle imprese di certificazione, che ne hanno fatto un modello di business, poco attente agli effettivi risultati ottenibili. La mia attenzione è spostata sull’effettiva applicabilità dei modelli gestionali alle PMI (indipendentemente dalla certificazione) ed in particolare a quelle dell’edilizia, dove l’attuazione dei modelli richiesti dal TUS si scontra con la diversa natura produttiva per cui sono nati (derivano tutti da aziende metalmeccaniche o chimiche: nulla esiste per l’edilizia, ossia come applicare modelli statici a situazione di lavoro dinamiche). Ecco perché l’attenzione primaria del blog è verso gli esempi e le buone pratiche di semplificazione. E’ in questa ottica che vi segnalo l’esperienza della AUSL di Forlì per l’adozione di un SGL semplificato. Allego i documenti che circolano in rete (un articolo di sintesi ed un esempio di procedure). Premetto che non sono molto interessanti per il nostro settore. Sia perché sono ancora basate sul “vecchio” 626 (quindi non aggiornate al TUS). Ma anche perché sono ancora una volta applicate solo ad imprese con impianti “fissi” (nello stesso articolo si sottolinea la non applicabilità per le imprese edili e si evidenzia come quello delle costruzioni sia il settore che più di tutti avrebbe bisogno di indicazioni in tal senso). POS-SGSL: Simplified procedure for the building of the Ministry of Labor Safety Newsletter

One of the most interesting themes that have developed around the issue of security is undoubtedly that of safety management systems in the workplace (SGSL), better known as processes for the "certification" of security. Outside of the interest on technical models proposed in Article 30 of the MLR (OHSAS 18000:2007 and UNI-INAIL), you can not record an undoubted difficulties in using these models of work processes within the building . Sottopongo alla vostra attenzione una possibile soluzione al problema denominata POS-SGSL. Ossia come sia possibile semplificare tutte le procedure semplicemente by a conjunction between the provisions of the legislation and procedures British OHSAS.
